Terms of Service

These Terms of Service ("Terms") govern your use of the Morning Briefing service and website operated by With Not For AI Consulting, LLC ("we," "us," or "our") at withnotfor.ai. By subscribing to or using the service, you agree to these Terms.

1. Service Description

The Morning Briefing is an AI-powered daily email digest service that summarizes your inbox and calendar using Anthropic's Claude API. The service is offered on a subscription basis at $20 per month. Features and delivery frequency are subject to change with reasonable notice.

2. Free Trial

New subscribers receive a 14-day free trial. No charge is made during the trial period. At the end of the trial, your subscription automatically converts to a paid plan at $20/month unless you cancel before the trial ends. You may cancel at any time during the trial with no charge.

3. Billing and Payment

• Subscriptions are billed monthly in advance. The first charge occurs at the end of your free trial.
• Payment is processed by Stripe. By providing payment information, you authorize us to charge your payment method on a recurring monthly basis.
• All fees are in US dollars and are non-refundable except as required by applicable law or as described in Section 4.
• If a payment fails, we will attempt to retry the charge. Your access may be suspended if payment cannot be collected after reasonable attempts.

4. Cancellation Policy

You may cancel your subscription at any time by emailing jack@withnotfor.ai. Cancellation takes effect at the end of the current billing period. You will continue to have access to the service through the period already paid for. We do not issue partial refunds for unused time within a billing period, except at our sole discretion.

5. User Responsibilities

By using the service, you represent and warrant that:

• You have the authority to grant us access to the email account and calendar you connect. You may not connect accounts that belong to others without their explicit consent.
• You will not use the service for any illegal purpose or in violation of any applicable laws or regulations.
• You will not attempt to reverse-engineer, scrape, or interfere with the service or its underlying infrastructure.
• The information you provide during onboarding and account setup is accurate and not misleading.

6. Data Processing Consent

By subscribing to the Morning Briefing service, you explicitly consent to the following:

• Your email content and calendar events will be transmitted to Anthropic's API for AI-powered summarization.
• This processing is necessary to provide the core functionality of the service. If you do not consent to this processing, you should not subscribe.
• Anthropic processes your data under their API terms. Content sent via the API is not used to train Anthropic's models.

7. Intellectual Property

The briefings we generate are derived from your own email and calendar data and are provided for your personal use. You retain ownership of your underlying data. We retain ownership of the service, software, branding, and all content we create that is not derived from your data.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED SUMMARIES WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WITH NOT FOR AI CONSULTING, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless With Not For AI Consulting, LLC and its members, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must cancel your subscription before they take effect.

12. Termination

We reserve the right to suspend or terminate your access to the service at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. In the event of termination by us without cause, we will refund any prepaid fees for the unused portion of your current billing period.

13. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Pennsylvania. You consent to the personal jurisdiction of such courts.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and With Not For AI Consulting, LLC with respect to the service and supersede all prior agreements and understandings.
